Conditions for fellow travelers
2. Search and book on workationers.io
Search
You can search for trips from organizers by entering criteria such as the type of trip, the destination, the travel dates and the number of guests. You can also use filters to refine your search results. The search results are based on relevance to your search and other criteria. Relevance takes into account factors such as price, availability, reviews, support and cancellation history, popularity, previous trips and saved listings, the organizer’s requirements (e.g. minimum or maximum number of participants) and more.
Apply
If you apply for a trip, you agree that your data will be passed on to the organizer. They will then contact you and invite you to a non-binding meeting. In the positive case, the organizer will accept your application. You then have seven days to make a binding booking for the trip. In the event that the booking period for the trip ends before the seven days have expired, the booking period for the trip or an explicitly defined exception by the organizer applies.
Booking
When you book a Trip, you agree to pay all fees for your Booking, including the Listing Price, applicable fees such as workationers.io service fees, offline fees, taxes and any other items specified during the checkout process (collectively, the “Total Price”). When you receive the Booking Confirmation, a contract for the Organizer Service (a “Booking”) is entered into between you and the Host. As such, in addition to these Terms of Use, you are subject to and responsible for complying with all terms and conditions of the Booking – including, without limitation, the Cancellation Policy and any other rules, standards, policies or requirements stated in the Listing or during the payment process. It is your responsibility to read and understand these rules, standards, guidelines and requirements before booking a Listing. Please note that some organizers work with co-organizers or a team to provide their organizer services.
Trip bookings
The booking of a trip constitutes a limited right granted to you by the organizer to enter, occupy and use the associated accommodation. The organizer is entitled to register you as a roommate and to hold you responsible for any damages as a partial tenant. If you continue to remain in the accommodation after the scheduled check-out date, the Organizer shall have the right to require you to vacate the accommodation in accordance with applicable law, including claiming any additional costs incurred by the Organizer as a result of your extended stay.
Booking a trip or other organizer service entitles you to contribute to, participate in or use this organizer service. You and all persons invited by you must meet the minimum age, ability, suitability and other requirements of the organizer. You must inform the Organizer of any illness, physical condition or other circumstances that may affect your ability to participate in or use the Organizer Service. Unless expressly authorized, you may not allow any other person to participate in an Organizer Service unless they are specified as an additional guest during the booking process.
3 Cancellation conditions
Sometimes unforeseen circumstances can lead to a trip being canceled. In order to ensure a smooth process while taking into account the other fellow travellers and the organizer, this policy allows for cancellation under certain circumstances. By booking a trip, the organizer and fellow travelers accept and agree to the relevant cancellation policy. A booking is considered confirmed when an initial deposit has been paid by the fellow travelers. In the event of cancellation by the fellow travelers or the organizer, the following process will be considered and implemented.
Every booking on Workationers.io is considered confirmed when an initial deposit is paid. The parties (organizer and fellow travelers) automatically accept the terms and conditions and the cancellation policy by making the booking. Please note that once you have booked a trip, the space in the itinerary is reserved exclusively for you. However, in unavoidable circumstances, the following cancellation policy will apply.
Free cancellation policy
The fellow traveler is entitled to a full refund in circumstances of a cancellation made within the first seven days of booking (hereinafter referred to as a reservation) in accordance with Workationers.io’s “seven day” cancellation policy in respect of reservations made to join a trip. This provision also applies if the organizer fails to communicate with the fellow traveller within seven days of the reservation. If the organizer does not contact the fellow traveler until the fifth day or after the fifth day but before the 7 days of the reservation have expired, the period for free cancellation will be extended by another five days.
Cancellations are only valid up to 10 days before departure.
In all other circumstances, the following cancellation conditions apply.
In the event of cancellation by the fellow traveler
For bookings already made by the organizer, the organizer must ensure that comprehensive documentation of the services already provided (booking/cancellation of accommodation, transport, activities and relevant events) is available. If this documentation is not available, the organizer must provide a full refund. If this documentation is available, the following procedure applies:
Cancellation of accommodation
Below are booking arrangements that an organizer has made in relation to accommodation for the trip and the refund options available for each scenario.
Money budgeted for unpaid accommodation must be reimbursed in full by the organizer.
Money used for prepaid double/multi-bed rooms/accommodation shall be refunded to the extent permitted by the respective provider’s cancellation policy and the other travelers in the group are not significantly disadvantaged. If a double room is half full and no other accommodation is available, the canceling fellow traveler will be reimbursed the difference between a double and a single room.
Money used for prepaid rooms shall be refunded to the extent permitted by the cancellation policy of the respective provider.
Cancellation of transportation
Listed below are booking arrangements that an organizer has made regarding transportation for the trip and the available refund options for each scenario.
Money budgeted for unpaid transportation costs (car, train, plane, etc.) must be reimbursed in full by the organizer.
Means of transport that have already been booked are only to be refunded if the other passengers in the group are not put in a bad position. For example, a rental car: If no other equivalent transport is available, the canceling passenger will only be reimbursed if this does not result in additional costs for the other passengers in the group.
Tickets or costs for individual transportation (car, train, plane, etc.) that have already been paid for shall be refunded to the extent permitted by the provider’s cancellation policy.
Cancellation of activities and similar events
Listed below are booking arrangements that an organizer has made in relation to activities or events for the trip and the refund options available for each scenario.
Money budgeted for unpaid activities (sightseeing, sports activities, etc.) and similar events must be reimbursed in full by the organizer.
Activities and other items that have already been booked are to be refunded to the extent permitted by the cancellation policy of the respective provider.
Costs for booked activities and other items cannot be refunded if this negatively affects the other travelers in the group. For example, group tickets: If no other equivalent option is available, the canceling fellow traveler will only be refunded if this does not result in additional costs for the other fellow travelers in the group.
This policy only allows cancellations for the events described above. The organizer is required to provide the necessary documentation of bookings made up to the cancellation date within 14 days of request.
Circumstances in connection with COVID-19:
For COVID-19 related cancelations and travel rules, the respective government regulations of the destination apply. Fellow travelers are obliged to comply with the quarantine, testing and vaccination requirements of the destination.
There is no reason for a free cancellation if the provider of accommodation or transportation or activities can fulfill their respective obligations (e.g. if an overnight stay in the accommodation is still possible). If the classification of the area does not directly affect such services, the traveler must pay cancellation fees.
A travel warning or the ordering of a negative test on arrival and/or return is not a reason for a free cancellation, nor are possible quarantine regulations in the home country. In the event of a travel warning, stays can only be canceled with costs in accordance with the general terms and conditions of the provider (contractual partner).
Likewise, local regulations, such as the central registration of all fellow travelers, quarantine regulations, curfews or leisure facilities that are only open to a limited extent or not at all on site, are not considered an obstacle to the trip.
The organizer must always remember to check the cancellation conditions carefully at the time of booking and choose an option that offers maximum flexibility. Cancellation free of charge is only possible if this has been contractually agreed in advance between the organizer and the provider (accommodation, transport and activity provider). Fellow travelers will receive a full refund in exceptional circumstances if third party providers (service providers) grant a full refund. Each cancellation is checked individually for each country.
Organizers fee
In the event of cancellation by a fellow traveller, the organizer may retain a maximum of 10% of the travel costs, up to a maximum of € 200. This would be compensation for the services already provided by the organizer (time spent on planning and coordination, necessary arrangements for booking accommodation or corresponding activities).
Platform fee
In the event of cancellation, the platform fee paid by the fellow travellers will be refunded in accordance with the refund value of the organizer’s costs. Example: If 80% of the travel costs are refunded to the fellow travelers, 80% of the platform fee will be refunded.
Workationers.io accepts no liability or responsibility for the consequences of travel cancellations or unforeseen circumstances during the trip.
In the event of cancellation by the organizer
If unforeseen circumstances beyond the organizer’s control occur after the booking has been made, which make it impossible or do not comply with local law to carry out the trip. The organizer must then offer a replacement in order to fulfil its obligations or postpone the trip to a later date. If this does not agree with the fellow traveler, the fellow traveler may cancel the trip and the amount of the refund will be determined by the above cancellation conditions.
Private agreements
This policy applies to all trips, regardless of what organizers state in their trip description or profile. In the event that you enter into a private cancellation agreement with the organizer, Workationers.io is not responsible for enforcing it or managing any disputes.
Correspondence and communication
We recommend that fellow travelers carefully read the fine print and important information in your trip description or have well-documented communication with your organizer.
What to do next
For the fellow traveler: Should you decide to cancel your travel booking due to unforeseen circumstances, please communicate with our support team or refer to the cancel option on the platform and follow the instructions there.
For the organizer: All cancellations will be moderated and forwarded by the Workationers.io support team. The organizer must confirm the percentage or amount of the refund to the Workationers.io support team. Finally, refunds will be processed by us via our payment provider Stripe. If this unexpectedly does not work, the refunds will be transferred manually via bank transfer. In any case, the refund will be initiated by the Workationers.io support team. The cancellation process or refunds should not be done privately by the organizer or fellow traveler.
Workationers.io will moderate the cancellation process and as an organizer or fellow traveller, when Workationers.io notifies or confirms that a cancellation has occurred in your trip, please follow the cancellation instructions provided by our support team. In addition, by completing a trip booking, organizers and fellow travellers agree to receive an email, phone call, or message from our support team to resolve any cancellation disputes in a friendly manner.

Conditions for mitigating circumstances
The Extenuating Circumstances conditions deal with cancellations where unforeseen events beyond your control occur after booking and make it impractical or illegal to complete. This policy applies to both accommodation and activity reservations.
If this policy allows for cancellation, it will take precedence over the reservation cancellation policy. Depending on the circumstances, fellow travelers affected by an event covered by this policy may be able to cancel their reservation and receive a cash refund, travel credit or other compensation. Organizers affected by an event covered by this policy may cancel without penalty if circumstances warrant.
What types of events are covered?
The term “event” is used in this policy to refer to the following occurrences that occur after a reservation is made, are unforeseeable at the time of booking, and prevent or prohibit the performance or legal enforcement of the reservation.
Changes in government travel policies: Unexpected changes in visa or passport restrictions imposed by the government that prevent travel to the destination. This excludes missing or expired travel documents and other personal situations that affect a fellow traveler’s ability to travel.
Military operations and other forms of conflict:
Acts of war, conflicts, invasions, civil wars, terrorism, explosions, bombs, rebellions, uprisings, riots, insurrections, civil disorder and civil unrest are examples of civil unrest.
Natural disasters: Natural disasters, acts of God, widespread critical utility outages, volcanic eruptions, tsunamis and other severe and unusual weather phenomena are examples of natural disasters. This excludes meteorological and natural phenomena that are common enough in this location to be expected, such as hurricanes during the Florida hurricane season.
Explanations of emergencies and epidemics:
Local or national emergencies, epidemics, pandemics and public health emergencies have been declared by the government. This excludes diseases that are indigenous to or frequently associated with a region, such as malaria in Thailand or dengue fever in Hawaii.
Travel restrictions imposed by the government:
A government entity has implemented travel restrictions that make it difficult or impossible to travel to, stay in, or return from the listing location. Non-binding travel advice and other government recommendations are not included.
4. your responsibilities.
You are responsible for your own acts and omissions and also for the acts and omissions of persons you invite to join or to whom you grant access to the booking of accommodation or discovery. This means, for example, the following: (i) you are responsible for leaving any accommodation (and related personal property) in the condition in which you found it; (ii) you are responsible for paying any culpable damage claims caused by you, your guest(s) or your pet(s); and (iii) you must always act with integrity, treat others with respect and comply with applicable laws.

5. hosting on Workationers.io.
Organizers
As an organizer, Workationers.io gives you permission to use the Workationers.io platform to offer your trip, discovery or other organizing service to our vibrant community of fellow travelers – saving you money. You can easily create a listing and have control over when and how you host fellow travelers. You set the location, availability and rules for each trip yourself. The accommodation price must correspond to the actual costs incurred. Otherwise, Workationers reserves the right to withhold a portion of the amount. Organizer profiles are publicly visible to both members and non-members.
Contracts with fellow travelers
When you confirm a booking application or receive a booking confirmation through the Workationers.io platform, you enter into a contract directly with the Traveler and are responsible for providing the Organizer Service on the terms and at the price specified in your listing. You are also responsible for paying all applicable fees such as Workationers.io’s service fee (and applicable taxes) for each booking. Workationers.io will deduct these amounts from your payouts unless we agree with you to do otherwise. Any terms or conditions you include in any Additional Traveler Agreement must: (i) be consistent with these Terms of Use, our Additional Legal Terms, our policies and the information provided in your Listing; and (ii) be clearly stated in your Listing description.
Independence from organizers
Your relationship with Workationers.io is that of an independent individual or entity and not that of an employee, agent, co-entrepreneur or partner of Workationers.io, except that Workationers.io Payments will act as a payment processor as described in the Payment Terms. Workationers.io does not manage or control your Organizer Service, and you decide in your sole discretion whether and when to offer Organizer Services and on what terms.
6. management of your advertisement.
Creation and management of your advertisement.
The Workationers.io platform provides tools that allow you to easily create and manage a listing. Your listing must contain complete and accurate information about your organizer service, your accommodation-related costs, other fees such as cleaning fees, fees for other services, fees charged outside the platform and any terms or requirements that apply to your fellow travelers or your listing. You are responsible for your acts and omissions and for ensuring that the information in your listing (including availability in the calendar) and the content (such as photos) is up to date and accurate. We recommend that you take out appropriate insurance for your Organizer Services and carefully review the terms and conditions of the insurance, including policy details and exclusions. You may only create one listing per trip. However, you may create multiple listings for timeframes if they take place in the same accommodation at different times. Each Discovery offered is subject to our additional terms and conditions for Discovery Organizers.
Familiarize yourself with your legal obligations
You are responsible for identifying and complying with all laws, rules, regulations and contracts with third parties that apply to your listing or organizer services. For example: Some locations require you to register fellow travelers staying in your rented accommodation. Please check your local laws to find out which regulations apply to the organizer services you wish to offer. Any information we provide in relation to legal requirements is for information purposes only and you should independently confirm your obligations. You are responsible for handling and using personal information of fellow travelers and others in accordance with applicable data protection laws and these Terms of Use, including our Organizer Privacy Standards. If you have any questions about the application of local laws, you should always seek legal advice.
Search ranking
The order in which listings are displayed in search results on the Workationers.io platform depends on a variety of factors, including these key parameters:
Your responsibilities
You are responsible for your own acts and omissions and are also responsible for the acts and omissions of persons involved in the performance of your organizer services. You are responsible for creating rules and requirements for your listing. You must include all fees and charges in your Listing description and may not collect any additional fees or monies outside of the Workationers.io platform, except as expressly permitted by our policy for fees paid outside of the platform. You must not solicit or encourage fellow travelers to create Workationers.io accounts, submit reviews, provide their contact details or take any other action outside of the Workationers.io platform in breach of our off-platform actions policy.
Hosting as a team or organization
If you are acting as part of a team, company or other organization or working with a co-organizer, the company and each person involved in the performance of organizer services are responsible as an organizer under these Terms of Service. By agreeing to terms or entering into contracts, you confirm that you are authorized to enter into contracts for and bind your team, company or other organization. If you perform other functions, you represent that you are authorized to perform those functions. If you instruct Workationers.io to transmit a portion of your payout to a co-organizer or other organizer or to send payments to another person, you must be authorized to do so and are responsible for the payment amounts and the accuracy of the payout information you provide.
7 Cancellations and travel complaints
If a fellow traveler cancels a booking, the amount paid to you will generally be determined by your cancellation policy applicable to that booking. As an organizer, you should not cancel fellow traveller bookings without a valid reason in accordance with our Special Circumstances Policy or applicable law. If you cancel a travel companion’s booking without a valid reason, we may charge a cancellation fee and take further action. If (i) a problem (as defined in the Rebooking and Refunds Policy) arises with a travel companion’s stay, (ii) special circumstances arise, or (iii) a booking is canceled in accordance with Section 13 of these Terms of Use, the amount paid to you will be reduced by the amount we refund or otherwise make available to the travel companion and any other reasonable costs we incur as a result of the cancellation. If a fellow traveler receives a refund after you have already been paid, or the amount of the refund and other costs incurred by Workationers.io exceed your payout, Workationers.io may recover that amount from you, including by offsetting the refund against your future payouts. Our Rebooking and Refunds Policy, our Special Circumstances Policy and these Terms of Use will take precedence over any cancellation policy you set in situations where they provide for cancellation of a booking and/or refunds to fellow travelers. If we can reasonably expect to issue a refund to a fellow traveler under any of these policies, payment for that booking may be delayed until a decision has been made regarding the refund.
Changes to bookings
Organizers and Fellow Travelers are responsible for any booking changes they make through the Workationers.io platform or Workationers.io support and agree to pay any additional amounts, fees or taxes associated with a booking change.
8. taxes
Taxes for organizers
As the Organizer, you are responsible for complying with your obligations under applicable law to properly report, collect, remit or include in your price any applicable sales or other indirect, occupancy, tourist, income or other taxes (“Taxes”).
Collection and transfer by Workationers.io
In locations where Workationers.io carries out the collection and/or remittance of taxes on behalf of Organizers, you instruct and authorize Workationers.io to collect and/or remit the taxes to the relevant tax authority on your behalf. All taxes collected and/or remitted by Workationers.io will be shown to Members in their transaction records. Workationers.io may claim additional amounts from Members (including by deducting such amounts from future payouts) if the taxes collected and/or remitted are insufficient to meet such Members’ tax obligations in full. You must contact the relevant tax authority if you wish to dispute any tax collected or claim a refund. We reserve the right to discontinue the collection and payment of taxes at any location at any time upon prior notice to the affected members.
Tax information
In certain jurisdictions, we may be required by tax regulations to obtain and/or report tax information about you and/or withhold taxes from payouts to you. If you fail to provide us with the documentation required by law to substantiate any such obligation to withhold taxes from payouts to you, we may withhold payouts up to the amount required by law until sufficient documentation is provided. You agree that Workationers.io may issue invoices or similar evidence of VAT, GST, excise or other taxes for your Organizer Services on your behalf to enable accurate tax reporting to our fellow travelers and their organizations.
General conditions
9. ratings.
Following each organizer service, fellow travelers and organizers have the opportunity to rate each other. Your review must be accurate and must not contain discriminatory, offensive, defamatory or other language that violates our Appropriate Content Policy or our Review Guidelines. Reviews are not checked for accuracy by Workationers.io and may be inaccurate or misleading.
10. contents.
Portions of the Workationers.io Platform allow you to provide feedback, text, photos, audio files, videos, information and other content (collectively, “Content”). By providing Content, in whatever form and by whatever means, you grant Workationers.io a non-exclusive, worldwide, royalty-free, sublicensable and transferable license, for the duration of the protection of the rights so licensed, to access, use, store, copy, alter, modify, create derivative works from, distribute, publish, transmit, stream, broadcast and otherwise exploit in any way the Workationers.io platform in any media or platform, known or unknown, including but not limited to the internet and social networks. Where content contains personal data, it will only be used for purposes that are permitted under data protection law; our Privacy Policy applies to our processing of such content. In cases where Workationers.io pays for or facilitates the creation of Content, Workationers.io may be the rights holder of such Content, in which case this will be mentioned in additional terms or disclosures. You are solely responsible for all Content that you provide and ensure that you either own the rights to such Content or are authorized to grant Workationers.io the rights described in these Terms of Use. You are responsible if your content infringes the intellectual property, privacy or data protection rights of others. Content must comply with our Appropriate Content Policy and our Anti-Discrimination Policy, which prohibit, among other things, discriminatory, obscene, harassing, fraudulent, violent and illegal content. Workationers.io may provide content translation services or automated tools, and you agree that your content may be translated using these services or tools. Workationers.io does not guarantee the accuracy or quality of translations, and members are responsible for verifying the accuracy of such translations.
11. fees
Workationers.io may charge Organizers and Travelers fees (and applicable taxes) for the right to use the Workationers.io platform. Any applicable fees will be displayed to Organizers before a listing is published and to Travelers before a booking is completed. For more information on when service fees apply and how they are calculated, please see our service fees page. Unless otherwise stated on the Workationers.io platform, service fees are non-refundable.
12. rules of the Workationers.io platform
Rules
You must follow these rules and must not help others or tempt them to break or circumvent these rules.
Reporting violations
If you believe that a member, listing or content poses an immediate risk to a person or property, contact the local authorities immediately before contacting Workationers.io. If you also believe that a member, listing or content is in breach of our standards, you should report your concerns to Workationers.io. If you have reported a problem to the local authorities, Workationers.io may request a copy of that report. Unless required by law, we are not obliged to take any action in response to a report.
Notifications of copyright infringements
If you believe that any content on the Workationers.io platform infringes your copyright, please notify us in accordance with our Copyright Policy.
13 Termination, blocking and other measures
Runtime
The contract between you and Workationers.io, which is reflected in these Terms of Use, will remain in force until either you or we terminate the contract in accordance with these Terms of Use.
Termination
You may terminate this Agreement at any time by emailing us or deleting your Workationers.io account. Workationers.io may terminate this Agreement at any time by giving you 30 days’ notice by email or by using any other contact details you have provided for your Workationers.io account. Workationers.io may also terminate this Agreement without notice and cease providing access to the Workationers.io platform if (i) you materially breach your obligations under these Terms of Use or our Additional Legal Terms or our policies, (ii) you violate any applicable law, or (iii) such action is necessary to protect the personal safety or property of Workationers.io, its members or third parties (for example, in the event of fraudulent behavior by a member) or (iv) your Workationers.io account has been inactive for more than two years.
13.3 Violations by Members. If (i) you are in breach of these Terms of Use, our Additional Legal Terms, our policies or our standards, (ii) you are in breach of any applicable law, regulation or third party rights, (iii) you have repeatedly received bad reviews or Workationers.io otherwise receives or learns of complaints about your performance or conduct, (iv) you have repeatedly canceled confirmed bookings or failed to respond to booking requests without good cause, or (vii) such action is necessary to protect the personal safety or property of Workationers.io, its members or others, or to prevent fraud or other unlawful activity, Workationers.io:
For non-material violations, or when otherwise possible and appropriate, Workationers.io will provide you with notice of any intended action and the opportunity to correct the problem, unless such notice would (i) prevent or impair the detection or prevention of fraud or other illegal activity, (ii) harm the legitimate interests of other Members or third parties, or (iii) violate applicable law.
Legal requirements
Workationers.io may take any action that is appropriate and necessary to comply with applicable law or the order or request of a court, law enforcement agency or other administrative or governmental authority, including the actions described above.
Effects of the termination
If you are an organizer and cancel your Workationers.io account, all confirmed bookings will be automatically cancelled and your fellow travellers will receive a full refund. If you cancel your Workationers.io account as a fellow traveler, all confirmed bookings will be automatically canceled. Any refund will be subject to the cancellation policy stated in the relevant listing. You will not be entitled to any reinstatement of your account or content following termination of this Agreement. If your use of the Workationers.io platform has been restricted, your Workationers.io account has been suspended or this Agreement has been terminated by us, you may not register a new Workationers.io account or use the Workationers.io platform through another member’s Workationers.io account.
Contradiction
You may appeal against any decision made by Workationers.io on the basis of this clause 13 by contacting Workationers.io support.
14. amendment of these terms of use
If we propose any changes to these Terms of Use, we will post the revised Terms of Use on the Workationers.io platform and update the “Last Updated” date at the top of these Terms of Use. We will also notify you of the proposed changes by email at least thirty (30) days before the new Terms of Use take effect. If the proposed changes to these Terms of Use are material, we will ask you to expressly agree to the revised Terms of Use. In the event of (i) non-material changes to these Terms of Use that do not affect material provisions, in particular provisions that define the nature and scope of the services provided by Workationers.io, or (ii) changes required by law, a final court decision or a binding order of a competent authority, your continued use of the Workationers.io platform after the effective date of the proposed changes will be deemed to constitute acceptance of the revised Terms of Use. In this case, we will also inform you in the notification email of your right to reject the proposed changes, the timeframe in which you may do so and your right to terminate this Agreement free of charge at any time prior to the effective date of the proposed changes in accordance with these Terms of Use.
15. clarification of complaints and damage reports
If a member can sufficiently prove that you, your fellow traveler(s) or your pet(s) have culpably damaged their accommodation or property or accommodation or property for which the complaining member is responsible, including consequential damage (“claim for damages”), the complaining member may demand compensation from you. You will be informed of the claim for compensation and given the opportunity to respond. If you agree to the payment, you authorize Workationers.io to collect the amount of the Damages Claim from you.
You agree to cooperate in good faith with Airbnb, to provide any information, execute any documents requested by Workationers.io and to take other reasonable actions in connection with any claim, member complaint, insurance policy claim or other claim related to your provision or use of the Organizer Services.
Any decisions made by Workationers.io in relation to a claim for compensation will not affect your contractual and statutory rights. Your right to take ordinary legal action remains unaffected.
16 The role of Workationers.io
We offer you the right to use a platform on which members can publish, offer, search for and book trips. When members make or confirm a booking, they enter into a contract directly with each other. Workationers.io is not and will not be a party or other participant in the contractual relationship between members. Workationers.io does not act as an agent for Members, except where Workationers.io acts as a payment processor as stated in the Payment Terms. Although we work hard to provide our Members with great experiences when using the Workationers.io platform, we cannot control the conduct or performance of fellow Travelers and Organizers and do not guarantee (i) the existence, quality, safety, suitability or legality of Listings or Organizer Services or (ii) the truth or accuracy of Listing descriptions, reviews or other content provided by Members. Workationers.io has no general obligation to monitor the use of the Workationers.io platform or to verify information provided by Members. However, Workationers.io has the right to review, remove, edit or disable access to content in order to: (i) operate, secure and maintain the Workationers.io platform (in particular for the purposes of fraud prevention, risk assessment, conducting investigations and customer support); (ii) ensure that Members comply with these Terms of Use; (iii) comply with applicable law or the order or requirement of a court, law enforcement agency or other administrative or governmental authority; (iv) respond to Member Content that we determine is harmful or objectionable; (v) take actions as set forth in these Terms of Use; and (vi) maintain and enforce quality or suitability criteria, including removing listings that do not meet the quality and suitability criteria. If we remove or disable access to content, we will notify the member concerned and provide the reasons for such action, unless such notification would (i) prevent or impair the detection or prevention of fraud or other illegal activity, (ii) harm the legitimate interests of other members or third parties, or (iii) violate applicable laws. You may appeal any such decision by contacting Workationers.io support. Members agree to cooperate with Workationers.io, to assist Workationers.io in good faith and to provide Workationers.io with such information and take such action as Workationers.io may reasonably request in relation to any investigation conducted by Workationers.io into the use or misuse of the Workationers.io platform.
17. workationers.io accounts
You must register a Workationers.io account in order to access and use certain features of the Workationers.io platform. Registration is only permitted for legal entities, partnerships and individuals aged 18 years or over. You represent and warrant that you are not a person or entity barred from using the Workationers.io platform under the laws of the United States, your jurisdiction of residence or any other applicable jurisdiction. You must provide accurate, current and complete information when registering and keep the information in your Workationers.io account up to date. You may not register more than one Workationers.io account or transfer your Workationers.io account to someone else. You are responsible for maintaining the confidentiality and security of your login details and must not disclose them to any third party. You must notify Workationers.io immediately if you suspect that your login details have been lost, stolen or your Workationers.io account has otherwise been compromised. You are responsible for all activities that occur through your Workationers.io account, unless those activities were not authorized by you or otherwise caused by your negligence (for example, by failing to report unauthorized use or loss of your login credentials). If and to the extent permitted by applicable law, we may, but are not obligated to, (i) ask you for identification or other information, (ii) conduct checks to verify your identity or background, (iii) verify you using external databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or registrations as sex offenders or their local equivalents.

We do not guarantee the existence, conduct, performance, safety, quality, legality or suitability of any fellow travelers, organizers, organizer services, listings or third parties and do not guarantee that any verification, identity or background checks of members (if applicable) will uncover past misconduct or prevent future misconduct. Any indication that a Member has been “verified” (or similar wording) indicates only that the Member or Workationers.io has completed an appropriate verification or identification process. We are not responsible for any failure or disruption to the internet and telecommunications infrastructure which is beyond our control and which may result in interruptions to the availability of the Workationers.io platform. Workationers.io may temporarily limit the availability of the Workationers.io platform or certain features of the Workationers.io platform, taking into account the legitimate interests of members (e.g. by giving prior notice), if this is necessary in view of capacity constraints, the security or integrity of our servers or to carry out maintenance measures that ensure the proper or improved functioning of the Workationers.io platform.
19. liability
Workationers.io shall be liable in accordance with the statutory provisions for intent and gross negligence on the part of Workationers.io, its legal representatives, executives or other vicarious agents. The same applies to the assumption of guarantees or any other strict liability or in the event of culpable injury to life, limb or health. In the event of slightly negligent breaches of material contractual obligations by us, our legal representatives, executive employees or other vicarious agents, Workationers.io’s liability shall be limited to the foreseeable damage typically occurring. Material contractual obligations are those obligations of Workationers.io on whose fulfillment you regularly rely and may rely for the proper execution of the contract. Any further liability of Workationers.io is excluded. Insofar as the liability of Workationers.io is excluded or limited, this shall also apply to the personal liability of its legal representatives, managing directors, employees and other vicarious agents.
20. exemption
You will indemnify, defend (at Workationers.io’s option), indemnify and hold Workationers.io harmless from and against any claims, liabilities, damages, losses and expenses, including, without limitation, the costs of necessary legal defense and accounting, that may arise in connection with: (i) your violation of these Terms of Use (including any additional or supplemental terms applicable to a product or feature), our additional legal terms, our policies or standards, (ii) your improper use of the Workationers.io platform, (iii) your interaction with any Member, your participation in any Trip, your participation in any Discovery or your use of any other Organizer Service, including, without limitation, any injury, loss or damage (whether compensatory, direct, incidental, consequential or otherwise) of any kind, arising in connection with or as a result of such interaction, stay, participation or use, (iv) your failure or our failure, at your direction, to properly report, collect or remit taxes, or (v) your violation of any law, regulation or third party right, such as intellectual property rights or privacy rights, or (vi) your failure to comply with any applicable law, regulation or third party right. intellectual property rights or privacy rights. This indemnification obligation applies only if and to the extent the claims, liabilities, damages, losses and expenses are caused by your negligent breach of a contractual obligation.
